Visa applications
A visa, or more correctly, entry clearance is a document which is obtained from a UK Border Agency office based at a British embassy or high commission before travelling. The entry clearance facilitates the holder’s travel to the UK, and s/he can only be refused entry in restricted circumstances; i.e. possession of an entry clearance is usually sufficient for the holder to be admitted to the UK.
The generic term entry clearance is broken down in to three sub-categories:
- Visa – a form of entry clearance that must be obtained by citizens of those countries listed in Appendix 1 of the Immigration Rules
- Entry certificate – a form of entry clearance that must be obtained by citizens of those countries not listed in Appendix 1, but who intend to stay in the UK for longer than six months. An entry certificate can also be sought for lesser stays, although there is no absolute requirement to do so; and
- Family permit – a form of entry clearance sought by those of any non-European Economic Area (EEA) nationality who wish to join a family member in the UK who is of an EEA nationality.
Either a visa or entry certificate application will be for a specific purpose, e.g. as a visitor, student, settlement etc. Each permitted purpose is governed by a particular paragraph of the Immigration Rules, and a family permit application will be considered by the relevant European Council Directive, which is transposed in to UK law as the Immigration (European Economic Area) Regulations 2006.
