In-country applications are made to the UK Border Agency (UKBA) by those who are already in the UK and who wish to either extend their stay or switch in to a different category.
As with visa and entry certificate applications, the bases upon which a person might wish to extend his/her stay are governed by the Immigration Rules
It is very important that a person wishing to make an application to extend his/her stay does so before the current status expires. Failure to do so will result not only in s/he being deemed to have overstayed, making them liable to being required to leave the UK, but will also mean that there is no statutory right of appeal should the UKBA subsequently refuse an application. Providing that the valid application is made “in-time”; i.e. before the current status finishes, the person’s permission to be in the UK will automatically be considered to be extended on the same terms and conditions until such a time as either the UKBA has favourably decided the application, or the ensuing appeal process is exhausted.
For those who have stayed longer than permitted in the UK, it might still be possible to make a late application to the UKBA. Alternatively, such a person might make the decision to leave and seek entry clearance to return. However, the best course will depend upon an individual’s personal circumstances.
Upon formal instruction, we are able to prepare and submit to the UKBA your in-country application, with reference to current law and policy, placing your own circumstances in context. As your named representatives, the UKBA should inform us of the outcome of your application, and we undertake to immediately inform you of their decision. In-country applications to the UKBA are made by either post, or in certain circumstances, through the offered same-day service.
Those who either entered the UK as family members of a European Economic Area (EEA) citizen, or entered under the Immigration Rules but think they have since derived a European right, may make an application to the UKBA under European law.
